<p>A Dutch lawyer is attempting to get his client out of jail with an unusual argument &#8211; he is too tall and fat for his cell.</p>
<p>Bas Martens said his client is about 6 feet 10 inches tall and weighs 35 stone.</p>
<p>The prisoner, identified under Dutch privacy law by his initials, AM, is serving a two-year sentence for fraud.</p>
<p>Court spokeswoman Paula Keuning confirmed that a hearing took place on Thursday and a ruling is due on February 8.</p>
<p>The lawyer described his client as &#8220;a giant&#8221;, and argued his imprisonment is so painful it violates European human rights law.</p>
<p>Speaking on national radio, he said electronically supervised house arrest would be more fair. </p>
