A British security contractor on trial for the alleged murder of two colleagues in Iraq is expected to find out his fate.

Judges in the case of Danny Fitzsimons, 30, from Greater Manchester, will make a ruling after considering medical reports on his mental state at the time of the shooting in August 2009.

He is the first Westerner to be tried by an Iraqi court since the start of the Iraq war nearly eight years ago and could face the death penalty if convicted.

Fitzsimons told a three-judge panel last month that he was acting in self-defence when he shot his ArmorGroup colleagues Paul McGuigan, a former Royal Marine from Peebles in the Scottish Borders, and Australian Darren Hoare.

His account that they had threatened to kill him after a whisky-fuelled brawl in Baghdad’s Green Zone has been disputed by Mr McGuigan’s fiancee Nicci Prestage.

Fitzsimons is charged with two counts of premeditated murder and the attempted murder of an Iraqi guard.

He pleaded not guilty to the killings but asked the judges to consider a plea agreement that would convict him on lesser manslaughter charges.

The court was expected to pass verdict on January 23, but the judges moved for an adjournment to consider Fitzsimons’ mental state and the trial will resume today.

Ms Prestage, 37, said the stress of waiting for the verdict was “intolerable.”

She lives in Tameside near Manchester with her daughters Elsie-Mai, Mr McGuigan’s child who was born prematurely just weeks after his death, and 13-year-old Leigh.
